Minutes for HB2007 - Committee on Transportation

Updating motor carrier laws and the regulation of motor carriers by the state corporation commission.

Chairperson Petersen called the meeting to order and opened the hearing on  HB2007.

Assistant Revisor Adam Siebers provided a briefing on the bill (Attachment 1).  He explained that the bill provides comprehensive changes to the motor carrier laws and certain changes to the Kansas Corporation Commission's (KCC) regulation of motor carriers.  He noted that motor carriers may receive notices electronically if authorized by the motor carrier, and he outlined sections of the statutes to be repealed or updated.

Mike Hoeme, Director of Transportation, KCC, speaking as a proponent via WebEx, provided background for the bill and reviewed details addressed by the bill (Attachment 2).  He explained that, because of deregulation years ago, some statutes are now obsolete or outdated; the bill adjusts the statutes to better reflect present transportation conditions.  He noted that an identical bill was passed by the committee the previous year (2020) (HB2524) and that the present bill includes an amendment made to last year's bill.  Mr. Hoeme said the present bill is a collaborative effort with the Federal Motor Carrier Safety Administration, the Kansas Highway Patrol, and the Kansas Motor Carrier Association.

Mr. Hoeme responded to members' questions:

  • One of the reasons for including email for communication is that if a carrier wants to participate in KTrend, email is required. 
  • Some details are being struck from statutes (e.g., ground water well drilling rigs) so that they can be addressed by rules and regulations, an option which allows more flexibility.

The Chair closed the hearing on HB2007 and announced that Committee meetings would occur on Tuesday, Wednesday, and Thursday with the possibility of adding a Monday and/or a Friday.  The meeting was adjourned at 8:49 a.m.
