Chairperson Owens opened the hearing on HB2705.  Natalie Scott provided an overview of the bill. (Attachment 1)  Ms. Scott stood for questions.

Thomas Stanton testified in support of the bill.  He stated the purpose of this bill is to replace the term "rebuttable presumption" in K.S.A. 21-5705(e) with the term "permissive inference" and add language to make it clear that the evidence presented by the State at a jury trial supports the jury's consideration of the permissible inference. (Attachment 2)  Mr. Stanton stood for questions.

Chairperson Owens closed the hearing on HB2705.
