Exempting certain modifications on antique vehicles from vehicle identification number offense seizures and dispositions.

The Chair called the meeting to order with Adam Siebers providing an explanation of the bill. Mr. Siebers said HB 2594 would create an exemption to KSA 8-116 specifically for antique vehicles defined as 35 years or older. The exemption would allow removal and re-installation of a VIN or serial number for necessary repair or restoration. The exemption would not apply if a person has knowledge of the vehicle having been stolen (Attachment 1).
Representative Leo Delperdang, District 94, provided testimony in support of HB 2594 (Attachment 2). He digressed from referring to the document provided and spoke from personal experience while in conversation with other antique vehicle enthusiasts. He stated that the Kansas law prohibiting the removal of a VIN is fitting for newer cars, but for antique cars being restored, an exception needs to be included in the statutes.
Mr. Samuel MacRoberts, Litigation Director and General Counsel, Kansas Justice Institute, testified regarding the unfairness of Kansas' statutes for antique vehicles (Attachment 3). He noted an ongoing case involving an innocent owner of an antique vehicle having received the ultimatum that the vehicle has been listed as contraband and needing to be destroyed. Mr. MacRoberts allowed this to be an overreach of government powers.
