Chairperson Owens opened the hearing on HB2634.  Natalie Scott provided an overview of the bill. (Attachment 16)  There were no questions for Ms. Scott.

Greg Smith testified in support of the bill saying that if enacted, this bill would require a person in Kansas charged with a felony to sign, as a condition of bond, a waiver of extradition.  Forty-eight states belong to the Uniform Criminal Extradition Act (UCEA) with Missouri being one of the states that do not belong to the UCEA.  In 2021, the Johnson County District Courts filed a total of 246 fugitive cases from out of state fugitives that refused to waive extradition with 193 of those cases being from the state of Missouri. (Attachment 17)  Deputy Smith stood for questions.

Shane Rolf testified in support of the bill stating that the Kansas Bail Agents Association supports the concept set out in this bill.  As this relates solely to defendants who have already been charged, arrested and granted pretrial release in Kansas, there seems to be little reason for them to be allowed to flee the State of Kansas and then abuse the UCEA to delay or interfere with the progression of their already initiated prosecution here. (Attachment 18)
