Minutes for SB366 - Committee on Judiciary

Short Title

Specifying that the crime of burglary includes, without authority, entering into or remaining within any locked or secured portion of any dwelling, building or other structure, with intent to commit another crime therein.

Chairperson Warren opened the hearing on SB366.

Jason Thompson, Senior Assistant Revisor, provided an overview of SB366. (Attachment 2) Mr. Thompson responded to questions from Committee members. 

Ed Klumpp testified in support of SB366 stating current statutes defining burglary do not cover substructures or subsets of a structure if the outer building, or structure, was entered lawfully. (Attachment 3) Mr. Klumpp responded to questions from the Committee members.

Written testimony support SB366 was submitted by Todd G. Thompson, Legislative Chair, Kansas County & District Attorneys Association. (Attachment 4)

Chairperson Warren noted for the Committee the Kansas County & District Attorneys Association is asking for more clarity and protections by amending statute to align with legislative intent for dwellings and buildings in non-public rooms.

Scott Shultz, Executive Director, Kansas Sentencing Commission submitted a SB366 Prison Bed Impact Assessment. (Attachment 5)

Chairperson Warren called for any further proponent, opponent, or neutral testimony and seeing none, called for final questions from the Committee.
