Minutes for HB2513 - Committee on K-12 Education Budget

Short Title

Requiring school districts to provide copies of certain tests, questionnaires, surveys or examinations to parents prior to obtaining consent to administer such test, questionnaire, survey or examination and prohibiting collection of personally identifiable student data.

Chairperson Williams opened the hearing on HB 2513

Nick Myers, Revisor from Kansas Office of Revisor of Statues, reviewed HB 2513 bill brief with the Committee. (Attachment 4)

Mr. Myers took questions from the Committee.

Chairperson Williams noted to the Committee that the Fiscal Note has been received for HB 2513.

Linda Highland, Citizen, provided testimony regarding support of HB 2513. She noted that Kansas was the first in the nation to adopt comprehensive social, emotional and character development model standards for grades K-12. She voiced her concern for data that was being collected from each student, the types of questions being asked, and the number of surveys that each student takes that supports the social, emotional and character development curriculum. She also noted her concern with the lack of transparency that the parents have in regards to the surveys and the data collected on their child.  She was worried about how the data was being stored and how it is being used.  She suggested that parents should have the right to read and approve the surveys administered to their children. Lisa Huesers provided testimony regarding support of HB 2513. Ms. Huesers noted since the Student Data Privacy Act was passed in 2014, non-parent interests have attempted to diminish or block fundamental parent authority in regards to their own children. She noted concern with who has access to the survey data, how is the data being used and how long the data is stored  She voiced her concern over the lack of transparency the parents have in regards to the surveys, the questions being asked and the parents access to the surveys.  (Attachment 13)

Tiffany Ellison provided testimony regarding support of HB 2513.  She noted her concern with how unaware parents are about these surveys and how they are being used. She voiced her concern on how this data is being used outside the districts and how it could be used to determine the student's future progress in school. She insisted that parents want transparent communication on how the data is being collected, where it is being used and with whom it is being shared. (Attachment 14)

Phillis Setchell provided testimony regarding support of HB 2513. She noted that she was not only representing herself, but also the Culture Shield Network. She noted that parents should have the right to read and approve whether to administer these surveys that ask very personal questions to their children.  She also noted that she was concerned with how long the data is being stored, if the data is being sold and who would own these personal records. (Attachment 15)

Dr. Walt Chappell, President of Educational Management Consultants, provided testimony via Webex regarding support of HB 2513. Dr. Chappell voiced his concern on how much data is being collected on every public and private school student.  He noted he was concerned about the security of the data.  He spoke that parents should have a right to see these surveys and make an informed decision if their child should participate.  (Attachment 16)

The conferees responded to questions from the Committee.

Chairperson Williams noted to the Committee that written testimony was received.

There being no further conferees, Chairperson Williams closed the hearing on HB 2513.
