Revising laws relating to operating an aircraft under the influence, including prescribing criminal and administrative penalties and providing for testing of blood, breath, urine or other bodily substances, and preliminary screening tests of breath or oral fluid.

Chairperson Warren called for discussion and possible final action on HB2387.

Jason Thompson, Senior Assistant Revisor, provided a background reminder and overview of HB2387 along with distributing and discussing a technical amendment to update HB2387 for the current year. Mr. Thompson pointed out there were a couple of grammar and wording changes that were also considered to be technical updates. (Attachment 1) The revisor stood for questions.

Senator Wilborn moved, Senator Thompson seconded, to adopt the technical amendment. The motion carried.

Mr. Thompson distributed a second amendment regarding sentencing that suggested changes to make the language consistent within the statute. (Attachment 2) The revisor discussed the changes and responded to questions from Committee members.

Senator Thompson moved, Senator Gossage seconded, to adopt the sentencing amendment. The motion carried.

Chairperson Warren called for questions or further discussion from the Committee and seeing none called for final action on HB2387.

Senator Gossage moved, Senator Wilborn seconded, to recommend HB2387 favorably for passage, as amended. The motion carried.

The next meeting will be January 19, 2022.
