Short Title
Requiring any individual or agency selling an abandoned or towed vehicle to acquire a certificate of title from the division of vehicles before the sale.

Staff briefed the Committee on this bill and answered questions. (Attachment 1)
The Chairman recognized Representative Awerkamp as the first proponent. (Attachment 2) He explained that HB2294 would require that an abandoned or towed vehicle receive a title prior to being sold at public auction.
The next proponent was Steve Denton.(Attachment 3) According to Mr. Denton these abandoned or towed vehicles can be sold with a possessory lien affidavit and the tow lot is supposed to have all the required inspections and paperwork done prior to selling the vehicle at public action. He said this is not always the case. Mr. Denton said some remedy needs to be considered as this has put undue stress, time constraints and financial burden chasing down these titles. He stood for questions.
Chairman Proehl recognized Tom Whitaker as an opponent to this bill.(Attachment 4) According to Mr. Whitaker this bill moves the process and expense of obtaining a Vehicle VIN Inspection (MVE-1) and titling a vehicle purchased at a Towing and Recovery Possessory Lien public auction from the salvage vehicle dealer to a towing company or public agency providing towing and recovery service.
When Chairman Proehl asked if there were any other proponents, Heather Klamm came forward and spoke in support of this bill.
There were no other proponents, opponents or neutrals so Chairman Proehl closed the hearing on HB2294 and opened the hearing on HB2458.
