Minutes for HB2201 - Committee on Transportation

Chairperson Petersen called the meeting to order and opened the hearing on HB2201.

Assistant Revisor Adam Siebers reviewed the focus of the bill.  He explained that the bill would amend the Eisenhower Legacy Transportation Program (IKE) to allow expansion projects under IKE to utilize federal stimulus funding and would reduce the minimum dollar threshold required to utilize alternative delivery from $100 million to $10 million.  In contrast to the companion Senate bill (SB116), the bill removes the 18% bond-dept cap (Attachment 1).

Lindsey Douglas, Deputy Secretary, Kansas Department of Transportation (KDOT), testified as a proponent for the bill (Attachment 2).  She reviewed the provisions of the bill and noted that the House Transportation Committee removed the 18% bond-debt cap; she stated that KDOT would accept either the House or Senate version.  Responding to a member's question, she explained that the federal regulations place the bond-debt cap at 18% of gross (rather than net) State Highway Fund revenues.

The Chairperson referenced the following written-only testimony in support of the bill:

  • Deborah Barnes, Staff Attorney, League of Kansas Municipalities (LKM (Attachment 3);
  • Michael White, Executive Director, Kansas Contractors Association (Attachment 4);
  • Jason Watkins, Wichita Regional Chamber of Commerce (Attachment 5); and
  • Brett Letkowski, Chair, South Central Kansas Transportation Coalition (Attachment 6).

The Chair closed the hearing on HB2201 and invited members to consider actions on the bill.

Senator Claeys moved and Senator Pyle seconded to strike the language of HB2201 and insert the language of SB116.  The motion passed.
