Chairman Longbine opened the hearing on HB2136. Eileen Ma, ROS, presented an overview of the bill. (Attachment 3)
Lee Modesitt, Director of Government Affairs and Communications, KID, appeared in person as the only conferee and oral proponent of the bill. (Attachment 4)
There was discussion regarding the differences between SB78 and HB2136. Senator Pittman asked if Turo (Huber) or other entities like it would be covered by the bill, and Mr. Modesitt said it would not be included.
Chairman Longbine suggested a conceptual amendment on page 3, at line 14 to insert the word "club" between "automobile" and "service"; and on page 3, line 15, start with the word "club" before "contract."
Senator Olson moved, seconded by Senator Holscher, to adopt the proposed amendment. The motion carried.
Senator Olson moved, seconded by Senator Peck to strike "statute book" on page 15, and change the effective date to its publication in the Kansas Register. The motion passed.
The Chair closed the hearing on HB2136. He asked the committee if they desired to work the bill at this time.
Senator Peck moved, seconded by Senator Gossage that HB2136 be passed, as amended, with favorable recommendation from the committee. The motion carried.
Chairman Longbine called for discussion and action on SB290. There was discussion about why the Stabilization Fund was a government agency. The Chair commented that it was set up as a "fee fund" sometime in the 1970s when it was enacted. He suggested that Jerry Slaughter would probably know that piece of history.
Senator Gossage moved, seconded by Senator Olson that SB290 be passed with favorable recommendation from the committee. The motion carried.
Chairman Longbine called for discussion or actions on HB2379 -- the ride share bill, which passed 123-0 in the House.
Senator Pittman moved, seconded by Senator Gossage that HB2379 be passed with favorable recommendation from the committee. The motion carried.
Chair Longbine gave a brief reminder of the upcoming activities -- on Wednesday 3-24-21, an informational presentation on payday lending by Melissa Wangemann from the State Bank Commissioner's Office. On Thursday 3-25-21, the committee will hold a confirmation hearing for Daniel Klucas' appointment to Securities Commissioner, then reopen and complete the hearing on SB199, followed by action on the bill. On Monday, 3-29-21 and Tuesday 3-30-21, via special permission from Senate President, Ty Masterson, the committee will hear SB288, a bill regarding the technology enabled trust bank act.
Adjournment was at 10:00 am. The next scheduled meeting is Wednesday, March 24, 2021 at 9:30 am in room 546-South of the Capitol.
