Minutes for SB158 - Committee on Transportation

Short Title

Prohibiting the towing of vehicles outside the state of Kansas without prior consent, requiring an interstate search of registered owners and lienholders prior to sale of nonrepairable vehicles and vehicles less than 10 years old and requiring publication in the newspaper seven days prior to sale of vehicles and property at auction.

Chairperson Petersen called the meeting to order at 8:36 a.m. for consideration of bills.

Assistant Revisor Adam Siebers briefed the committee on the changes in SB 158 prohibiting vehicles being towed outside the state of Kansas without prior consent. He noted towing service providers must have consent of the driver or owner of a vehicle for out-of-state delivery, and he reviewed regulations required prior to the sale of a vehicle (Attachment 1).

Tom Whitaker, a proponent of the bill, noted that forty member-firms collaborated with the Kansas Department of Revenue to update the documents necessary to secure a title for vehicles sold at auctions.  He said the bill's language is very similar to a Missouri law; it is designed to avoid vehicles being towed from one state to another just to avoid lien laws.  Mr. Whitaker requested amendments be made to the bill to provide additional protection for purchase of auctioned vehicles (Attachment 2).

Written proponent testimony was submitted by LeeAnn Phelps, Manager of Vehicle Services, Kansas Department of Revenue (Attachment 3).
