Substitute for HB 2049 by Committee on Judiciary - Prohibiting a public agency from charging a fee for records requested for an audit by the legislative division of post audit.

Chairperson Bowers opened the hearing on HB2049.  Jason Long, staff revisor, presented a briefing on the bill.

Justin Stowe testified in support of HB2049.  Mr. Stowe stated this concept is supported by the Post Audit Committee to help ensure that there are no barriers to the audits performed on your behalf.  Mr. Stowe indicated if they ask for these records under the Kansas Open Records Act (KORA), they would pay the fees like any other agency.  Mr. Stowe stated this is specific to when they are doing an audit.  (Attachment 2)

Deborah Barnes provided neutral testimony for HB2049.  Ms. Barnes' testimony stated they support the changes made by the House to place this provision in the Legislative Post Audit statutes rather than in KORA.  (Attachment 4)
