Senator Doll introduced an amendment for SB 52 wherein additional wording was introduced to specify "agricultural purposes" and intended to further exclude agriculture vehicles, grain elevators, and other agricultural property for nuisance abatement. Randy Stookey, Senior Vice President of The Kansas Grain and Feed Association, spoke briefly in favor of the amendment. Chris Lambrum, Director of the Sedgwick Building and Construction Department, also spoke in favor of the amendment and stated the nuisance abatement act is not intended to target rural, agricultural properties. Senator Doll and members of the Kansas Revisor's Office responded to questions from the committee. Chairperson McGinn moved to other amendments.

 

Senator Warren introduced three amendments for SB 52. The first amendment provides a definition for "personal service," to an existing Kansas statute. Senator Warren responded to questions from the committee. (Attachment 1)

Senator Warren moved to approve the amendment, seconded by Senator Thompson. Motion carried.

 

Senator Warren introduced a second amendment regarding the bill which helps to clarify "owner," and eliminates "agent of the owner," verbiage within the bill. Senator Warren responded to questions from the committee. (Attachment 2)

Senator Warren moved to approve the amendment with adjustments, seconded by Senator Francisco. Motion carried.

 

Senator Warren introduced a third amendment further defining verbiage within the bill, adding a new section to give property owners the right to appeal the hearing of the county board of commissioners. (Attachment 3)

Senator Warren moved. Senator Thompson moved to adopt the amendment. Motion carried.

 

Chairperson McGinn adjourned the meeting at 10:27PM. The next committee meeting is scheduled for Tuesday, February 2 at 9:30AM.
