Minutes for HB2081 - Committee on Corrections and Juvenile Justice

Short Title

Modifying how certain prior convictions are counted for the special sentencing rule related to possession of a controlled substance and providing concurrent or consecutive sentencing for persons convicted of new crimes while on release for a felony.

Chairperson Jennings called for discussion and final action on HB2081.

Natalie Scott, Assistant Revisor, reviewed the bill.

Representative Jennings offered a proposed balloon amendment to correct language consistent with the testimony the Committee received. The amendment to the bill is on page 6 line 35 changing the current words "two or more prior felony convictions" to "one or more prior felony convictions". (Attachment 1) The revisor discussed the recommended changes and responded to questions.

Representative Jennings moved, Representative Highberger seconded, adoption of the proposed balloon amendment provided by Representative Jennings.The motion carried.

Representatives Carmichael, Highberger, and Owens requested their 'Aye' vote be recorded.  Representative Kuether participated virtually off site; therefore, Representative Kuether did not vote.

Chairperson Jennings called for other amendments or discussion on the bill as amended.  Questions from the Committee were addressed  No additional amendments were proposed.

Representative Highberger moved, Representative Smith seconded, recommend HB2081 pass favorably as amended. The motion carried.

Representatives Carmichael, Highberger, and Owens requested their 'Aye' vote be recorded.  Representative Kuether participated virtually off site; therefore, Representative Kuether did not vote.
