Chairperson Vickrey opened the hearing on HB2487.
Jason Thompson, Office of Revisor of Statutes, presented a bill brief for HB2487. (Attachment 1)
Michael Lesser, testified in support of the bill. Mr. Lesser stated that HB2487 will correct an unfair application of workers compensation losses to Kansas companies' workers compensation MOD factor formula. Mr. Lesser responded to questions from the committee members. (Attachment 2)
Todd Harrington, testified in support of the bill. Mr. Harrington detailed how two of his employees were involved in an auto accident that was deemed not their fault, yet his company's MOD rating was adversely affected. (Attachment 3)
Will Larson, testified in support of the bill. Mr. Larson stated that the proposed bill would give the Insurance Commissioner the discretion to limit the amount of a loss attributable to a motor vehicle accident that can be included in the experience mod calculation in a situation where there is a no fault motor vehicle accident. (Attachment 4)
Brad Smoot, testified in opposition of the bill. Mr. Smoot explained that the problem is not the experience mod formula, but that the proponent's business clients are using the experience mod to determine eligible bidders and that was never the purpose of such ratings. Mr. Smoot responded to questions from the committee members. (Attachment 5)
Larrie Ann Brown, testified in opposition of the bill. Ms. Brown stated that this bill seeks to change the workers compensation system by inserting fault into a no-fault system. (Attachment 6)
Jason Thompson responded to a question from Representative Elizabeth Bishop.
