Chairperson Petersen called the meeting to order at 8:33 a.m. and opened the hearing on HB2222.
Assistant Revisor Adam Siebers briefed the Committee on the bill (Attachment 1). He explained that the bill requires ignition interlock device manufacturers to pay fees to the state for the administration of the ignition interlock program. He said the bill amends the statute to exclude the $5 monthly fee for certain individuals and establishes the IID fee program fund to be administered by the Kansas Highway Patrol (KHP) Superintendent.
Lieutenant Matthew Payne, Kansas Highway Patrol, testified as a proponent for the bill (Attachment 2). He reviewed the provisions of the bill and cited the statute that authorizes the KHP Superintendent to adopt rules and regulations to administer the IID fee fund program. He commented that the IID is a handheld breathalyzer device installed on a vehicle to prevent the ignition from starting the engine if alcohol is detected in a breath sample. He explained that the administrative responsibility for the program shifted from the Kansas Department of Revenue to the KHP in 2022. He cited data to illustrate the value of the interlock devices.
Responding to a question, Murl Riedel, Executive Officer, KHP, commented on the fiscal note: the bill will have no fiscal impact on the State General Fund; the bill shifts the administrative costs from the Kansas Department of Revenue to the KHP.
Ed Klumpp, Legislative Liaison, Kansas Association of Chiefs of Police, Kansas Sheriff's Association, and the Kansas Peace Officers Association, provided written-only support for the bill (Attachment 3).
