Chairman Waymaster opened discussion on the bill.
Representative Johnson made a motion for an amendment that would add $350,000 from SGF for the Department of Children and Families (DCF) for diligent recruitment for foster homes as noted in Item 6 of the Budget Committee Report for FY 2019 . Representative Ballard seconded the motion.
Discussion followed regarding the motion.

Representative Ballard made a motion for an amendment that would add $750,000 for the FY 2019 DCF budget for the feasibility study. Representative Landwehr seconded the motion.
Discussion followed regarding the motion. It was noted that a feasibility study is underway by the Office of Technology and Information System.
Representative Sutton made a substitute motion that would not add funding for the feasibility study and revisit this issue next year. Representative Williams seconded the motion.
Discussion followed regarding the motion. Representative Landwehr stated that a feasibility study is mandated by the federal government regarding any DCF changes. Representative Ballard reviewed components of the study would include foster care issues and mandates, with the primary focus on child welfare. The software system is over 15 years old, and changes can not be made without the federal requirement of a feasibility study. Chairman Waymaster stated that OITS has conducted an overall study on mainframe system for the state, and this would be a specific study that includes needs identified by the task force. The Governor did not recommend this study, as the study was not submitted in the original budget submission. Funding for the study would be a 50/50 match, Representative Ballard noted.

Representative Johnson reviewed a proviso which includes language that any remaining authority to issue bonds shall be limited to $200,000,000 of the net proceeds of the bonds issued pursuant to such sections and not the principal amount of the bond issuance (Attachment 3).
Representative Johnson made a motion to approve the proviso as related to issuance of bonds pursuant to Session Laws for FY 2018 and FY 2019. Representative Helgerson seconded the motion.
Discussion followed by committee members regarding the proviso. The proviso would have an impact on transportation maintenance programs, which has a $60 million budget shortfall for this year.
Representative Johnson renewed the motion. Motion passed.
Representative Aurand discussed the need for a placeholder in the budget that would include funding for K-12 education.
Representative Aurand made a motion for an amendment that would include placeholder funding for K-12 education in the budget for FY 2019, which would be the same amount as approved in the K-12 Education Budget in FY 2018. Representative Johnson seconded the motion.
Discussion followed by committee members regarding the amendment. Recommended funding would be the same amount as approved by the Legislature in FY 2018. Concerns were expressed regarding the Supreme Court's ruling that this funding was unconstitutional. In response to the approved funding for FY 2019, JG Scott, Legislative Research Department, stated that the approved budget was $3.3 billion, and all funds of approximately $4.9 billion. Chairman Waymaster stated the the K-12 Education Budget Committee will begin working on this budget now that the results of the recent study has been completed.
Representative Helgerson discussed a substitute motion that would take the Governor's Recommendation for funding K-12 Education plus an additional $100 million . A review of the SGF for FY 2016 through FY 2022 followed (Attachment 4).
Representative Helgerson made a substitute motion that would provide the funding amount based on the Governor's recommendation for FY 2019, and add an additional $100 million to fund K-12 Education for FY 2019. Representative Alcala seconded the motion.
Discussion followed by committee members regarding the motion. The Governor's recommendation was $95 million more in FY 2019, the Legislature approved $100 million, and the motion would add an additional $100 million for K-12 Education funding. Concerns were expressed regarding negotiating a settlement on the pending litigation.
Representative Helgerson withdrew the motion, which was approved by the second to the motion.

Representative Concannon made a motion for an amendment that would open discussion for the Judicial Branch recommendation for pay increases. Representative Patton seconded the motion..
Representative Ralph made a substitute motion to review the Judicial Branch request for pay increases for further review at Omnibus. Representative Landwehr seconded the motion. Motion passed.
Representative Wolfe Moore made a motion for an amendment regarding the State Employee Pay increase adjustments for review at Omnibus. Representative Ballard seconded the motion. Motion passed.
Representative Johnson made a motion for an amendment that would add $194 million to the Kansas Public Employee Retirement System for review at Omnibus. Representative Phelps seconded the motion. Motion passed.
Representative Helgerson reviewed an amendment regarding the Emporia State University Nursing Program (Attachment 5).
Representative Helgerson made a motion for an amendment to take $535,000 from the Special Revenue Fund for the out-of-state Post-secondary Education Institution Fee Fund in the Board of Regents in FY 2019, for a 1 year appropriation for the Emporia State University Nursing Program. Representative Ballard seconded the motion.
Discussion followed regarding the motion. This is a one-year funding recommendation. Additional funding of the program would need to be identified from other funding sources.
Representative Landwehr made a substitute motion that would change the language in the original motion to state that the Board of Regents may transfer funds from the Post Secondary Education Institution Fee Fund. Representative Jones seconded the motion.
Discussion followed by committee members regarding the motion. If the funding is not authorized by the Board of Regents, the funds would lapse into the SGF. The fund balance to date is $3.2 million, it was noted.
Representative Landwehr renewed the substitute motion. Motion failed.

Representative Hoffman made a motion for favorable passage of House Sub HB 2468 as amended. Representative Williams seconded the motion. Motion passed.
