The Chairman opened the hearing on SB439 - Clarifying methods of recording grand jury proceedings. Jenna Moyer provided an overview of the bill. (Attachment 1)
Mike Kagay spoke in favor of SB439 and explained that his office is the only state prosecution agency that employs the grand jury on a primary and regular basis in place of the preliminary hearing system. He believes doing so has proven to be more efficient. The bill deals with issues which could arise if a court certified recorder could not be hired. (Attachment 2) Mr. Kagay answered questions from committee members.
Chairman Wilborn asked if there were any opponent or neutral conferees who would like to speak on SB439.
Phillip Cosby, American Family Action, offered neutral comments on SB439 and explained Kansas has two grand jury processes: the one addressed by Mr. Kagay and the citizen's grand jury. He found no fault with SB439 but cautioned that it is important to see that one system is not infringing on the other.
