Chairperson Hawkins called for final action on HB2549 and asked for a brief refresher of the bill.
Norm Furse, Revisor Emeritus, Office of Revisor of Statutes, briefed that HB2549 would clarify that defendants, regardless if they are charged with a felony or misdemeanor, could be committed to the state security hospital or any appropriate state, county, private institution or facility in order to be examined for competency. He sad the bill would also strike the definitions for Osawatomie State Hospital and Larned State Hospital catchment areas.
Representative Eplee moved to pass out HB2549 favorably, Representative Osterman seconded the motion.
Representative Barker made a motion for a proposed amendment which removes the language relating to catchment areas with Representative Dove offering the second (Attachment 3).
Discussion followed with confirmation of what was being struck from the bill and Representative Barker confirmed it was the catchment area which was supposed to be in certain counties and allows transfer to wherever there is an opening and lets the remainder of the bill uchanged. Representative Concannon responded she thought it would strike it from the statute; however, it does not, but just strikes it from the bill instead.
Representative Barker closed his motion to amend and the motion passed on a voice vote.
Representative Dove moved, Representative Osterman seconded to pass out HB2549 favorably as amended. The bill passed as amended on a voice vote.
