Mr. Myers, Office of the Revisor of Statute, gave an overview of SB389. The Committee was also provided a fiscal note. (Attachment 2)

Senator Alley asked how many people take the exam and what grade levels take it. It was clarified that 6th, 8th, 10th, and 12th graders take it during school hours, and it takes an average of an hour to take the test. Senator Alley asked if there have been concerns from parents with opting in and opting out. Lisa Chaney responded. Senator Alley asked if we knew the cost of taking the instruction and commented that they do not know that cost.
Senator Pettey asked clarifying questions about the survey. It was clarified that the survey is free, and the school uses the survey to get grants and uses data for community information and agencies.
Chairperson Baumgardner requested a copy of the CTE Survey that was not provided. A follow-up was presented at a later date. (Attachment 9) Chairperson Baumgardner asked when it was determined that parents can opt out. It was clarified that it was always that way, and Chairperson Baumgardner asked how Greenbush ensures parents are given that choice. Chairperson Baumgardner discussed her role as a teacher and parent, noting she has never had the option to opt out. Ms. Stallbaumer responded with what the law states. Ms. Huesers stated the procedures are outlined for what schools are to do. Chairperson Baumgardner asked if there was any follow up to ensure the schools are giving parents this option.
Senator Fitzgerald asked if there was any consequence to not following federal law. He asked if they have been warned in this subject. Ms. Huesers responded, yes, they have been warned by having audits performed.
Chairperson Baumgardner asked who introduced the bill into the Ways and Means Committee, and it was clarified that Representative Vicki Schmidt had.
