The Chair reconvened the meeting and announced continued consideration of HB2560.
The Chair announced that the Kansas Bureau of Investigation (KBI) is under the Attorney General's Office; the Attorney General is an elected official, a category which is specifically excluded from the bill. Further, the KBI operates the Kansas Criminal Justice Information System (KCJIS), a system separate from the state network; thus, law enforcement personnel under KCJIS are excluded from the bill.
Staff Jenna Moyer provided members with Substitute for HB2560 (Attachment 1). Ms. Moyer stated that she incorporated all the amendments from the previous meetings to create a substitute bill. She commented on the relevant changes in the substitute bill. Responding to questions, she replied that in regard to standards, she referenced NIST (National Institute of Standards and Technology), that the State Interoperability system is outside the state network, and that after two years the fee structure is subject to the rules and regulations process.
A motion was made by Representative Koesten and seconded by Representative Esau to recommend Sub for HB2560 as favorable for passage.
Members expressed concern that local entities may not understand the process for being a part of the state network. Representative Sloan moved, seconded by Representative Gallagher, to amend the substitute bill by inserting language to clarify validation requirements and delay implementing a new fee structure until January 1, 2020. The motion passed (Attachment 2)
Representative Pittman expressed concern that the bill goes too far too fast. Representative Pittman moved and Representative Curtis seconded to amend the substitute bill limiting the scope of the bill to the Executive Branch and to delay implementing certain provisions in the substitute bill (Attachment 3).
A member noted that the amendment eliminates the Chief Information Security Officer's authority for funding. Ms. Moyer commented that the current network fee structure is not in statute.
The Chair, before recessing the meeting until Monday, February 12, stated that the Pittman amendment would remain on the table, and he urged members to learn about the NIST standards and review the substitute bill with its present amendments.
