Mr. Wells provided an overview on HB2367 stating it is a carryover bill from last year. If the bill continues forward, it will need some small technical amendments to change from 2016 Supp. to 2017. The bill concerns property taxation relating to valuation and duties of the county appraiser. Mr. Wells stood for questions from the Committee.
Nathan Eberline, Kansas Association of Counties testified as a proponent to HB2367 stating in 2014, the Kansas Legislature overhauled the process for resolving valuation disputes regarding real property with more updates in 2016. The bill responds to three county concerns by: (1) allowing information requests during property appeals; (2) allowing efficient and cost-effective compliance with Article 11, and 1 of the Kansas Constitution; and (3) eliminating a needless and expensive step in the appeals process (Attachment 8). Mr. Eberline stood for questions from the Committee.
Greg McHenry, Riley County Appraiser's Office testified as a proponent to HB2367 stating there are 3 concerns they are focusing on which are: (1) to allow appraisers to request data to the most accurate valuation of properties; (2) to provide fairness and equity for properties of similar class; and (3) to eliminate unnecessary steps in the appeal process (Attachment 9). Mr. McHenry stood for questions from the Committee.
Ashley Biegert, Shawnee County Assistant County Counselor submitted written testimony as a proponent to HB2367 (Attachment 10).
Randy Stookey, Kansas Grain & Feed Association, Kansas Agribusiness Retailers Association and Renew Kansas testified as an opponent to HB2367 stating KGFA's membership includes over 950 Kansas business locations and represents 99 percent of commercially licensed grain storage in the state. He noted many of their members have experienced burdensome valuation of taxes in the last two to three years which causes many appeals. The bill would amend current law by removing protections for property owners and taxpayers (Attachment 11). Mr. Stookey stood for questions from the Committee.
Eric Stafford, Kansas Chamber testified as an opponent to HB2367 stating it repeals two important provisions from SB280 passed by the legislature in 2016 (Attachment 12). Mr. Stafford stood for questions from the Committee.
Patrick Vogelsberg, Kansas Association of Realtors testified as an opponent to HB2367 stating SB280, passed in 2016, brought fairness in the property tax appeals and valuation process for property taxpayers (Attachment 13). Mr. Vogelsberg stood for questions from the Committee.
Sean Miller, Kansas Building Industry Association submitted written testimony in opposition to HB2367 (Attachment 14).
After asking if there were any other conferees and seeing none, Chairperson Johnson closed the hearing on HB2367.
