Short Title
Motor vehicle liability insurance; amending uninsured motorist coverage provision requirements and increasing the minimum policy limit for bodily injury.

Representative Daniel Hawkins gave a report from the subcommittee in regards to HB2104. (Attachment 1) He stated that the subcommittee met twice in an attempt to obtain more information from various groups including the Kansas Insurance Department and various insurance companies and agents. He stated that they reviewed an Actuarial Report obtained by the Trial Lawyer's Association. Representative Hawkins also informed the committee that in 2016 a bill passed raising the PD (property damage) limits and that there was a piece inserted in that bill that said BI (bodily injury) and PD would be reevaluated every 10 years beginning in 2026 and that is in current statute. He added that no legislature can bind another legislature, however, they should stick with those agreements. Representative Hawkins concluded that due to the information they received in the subcommittee report and the current statute regarding reviewing PD and BI limits in 10 years that the subcommittee voted to not recommend HB2104 favorably for passage.
Representative Tim Hodge presented a minority report identifying reasons why HB2104 should be passed out favorably. (Attachment 2)
Chairperson Vickrey asked if there were any questions regarding the subcommittee report or minority report.
Representative Daniel Hawkins replied no to Representative John Epplee's question in regards to whether or not the subcommittee looked at raising the limits in smaller increments rather than doubling the minimum limits. Representative Tom Cox indicated to Representative Hawkins that he saw in the minority report that Representative Tim Hodge agreed with the subcommittee report regarding the UIM offset, but did not see that in the subcommittee report. Representative Hawkins stated that he believed Representative Hodge was referring to the data that showed that every single policy would be affected by UIM. Representative Hodge then stated that he did agree with the subcommittee that this would increase everyone's policy to varying degrees of .5-1.5% on premiums if you allow the offset.
Representative Tom Cox asked if the committee discussed requiring only high risk drivers not be allowed to purchase minimum limits. Representative Tim Hodge replied that the committee did not consider that.
Representative Daniel Hawkins made a motion, seconded by Representative Willie Dove to accept both the subcommittee report and the minority report. Motion carried.
