Chairperson Bowers opened final action on HB2333. Mike Heim, staff revisor, reviewed the bill.
Senator Sykes distributed and explained a balloon amendment. Mr. Heim indicated the last sentence of the balloon amendment states the audit will be in "even-numbered year elections;" it should state "odd-numbered year elections." Mr. Heim stated that the intent was to audit the local government elections. (Attachment 1)
Chairperson Bowers indicated written testimony for the bill was submitted by Rick Piepho, Harvey County Clerk and Election Officer, submitted on behalf of the Kansas County Clerks and Election Officials Association (KCCEOA) (Attachment 2)
Senator Sykes moved, Senator Haley seconded, to adopt the balloon amendment with the change from "even-numbered" to "odd-numbered." The Chair was in doubt on a voice vote, calling for division with a show of hands. Motion carried.
Senator Pilcher-Cook moved, Senator Fitzgerald seconded, to amend the bill per the request of the Secretary of State's office to become effective on January 1st, 2019. Motion carried.
Chairperson Bowers distributed a balloon amendment with a question to the revisor of whether this amendment would harm the bill. Mr. Heim stated it would not harm the bill, but the issue would be if it's necessary. The Committee did not discuss or move the amendment. (Attachment 3)
Senator Pilcher-Cook moved, Senator Sykes seconded, to recommend HB2333 as amended, favorably for passage. Motion carried.
