The Chairman opened the hearing on SB329 - Enacting the uniform partition of heirs property act. Jason Thompson provided an overview of the bill. (Attachment 10)
Senator Randall Hardy spoke in favor SB329 explaining the bill resulted from a constituent concern, but he has found that others across the state are experiencing similar difficulties. In addition to addressing individual concerns in Kansas, the bill would provide attorneys who practice across state lines to address only one law. (Attachment 11)
Janet Hoskins supported SB329 and told of her personal experience in having inherited property forced into a sheriff's sale by a co-tenant. Ms. Hoskins feels current law favors the party bringing a partition action and would like to see that Kansas law is equitable for all parties. (Attachment 12)
Chairman Wilborn noted written testimony in favor of SB329 submitted by John Pollock of the Heirs Property Coalition. (Attachment 13)
Conferees answered questions from committee members.
