Chairperson Petersen opened the hearing on this bill. Mr. Wells gave an overview. This bill makes amendments to the Vehicle Dealers and Manufacturers Licensing Act, to eliminate the annual salesperson license renewal testing requirement.
Don McNeely, President, Kansas Automobile Dealers Association, provided proponent testimony (Attachment 6). This bill was requested by former Senator Les Donovan following the Wichita Auto Dealers meeting last summer. For large dealers, this testing is cumbersome. The bill is endorsed by the Kansas Dealer Review Board and the Kansas Division of Motor Vehicles.
Senator Pettey asked if the current cost is borne by the dealership. Mr. McNeely said yes, and dealers will continue to pay their annual licensing fee. The testing is time consuming and larger dealerships might have 75-150 salespersons. The testing costs dealerships for things such as lost staff time.
Senator Goddard asked if there is an annual training requirement. Mr. McNeely said there is ongoing training, particularly at the medium and larger dealerships. Mr. McNeely added that the tests are open book, online, and they contain very basic questions. The testing is from the statutes, and there are limited statutes over which the salespeople can be tested.
Lee Ann Phelps, Vehicle Services Manager, Division of Vehicles, Kansas Department of Revenue, provided written testimony in support of the bill (Attachment 7).
