Chairperson Barker asked the Committee to open their files on HB2441. Jason Long, Revisor, gave an overview of the bill. Currently Legislative Post Audit is charged with conducting the financial compliance audit for the Kansas Lottery, the state audit under the Department of Administration, and the KPERS audit. This bill shifts the responsibility of contracting for those audits from Legislative Post Audit to each individual agency. A committee would be formed to contract for the security and the finance compliance audits for the Kansas Lottery. A separate committee would do the contracting for the state audits under the Department of Administration, and the Board of Trustees would do the contracting for the compliance audits of KPERS.
Representative Rooker moved to recommend HB2441 favorably for passage, seconded by Representative Ellis.
Chairperson Barker stated that he has a technical amendment (Attachment 1). The term "invitations for bids" is changed to "requests for proposals" to make it consistent with other post audit statutes. In addition, some statutory references were inadvertently left out when the bill was drafted so these have been reinserted.
Chairman Barker moved to amend HB2441 as stated above, seconded by Representative Whitmer. Following discussion, a vote was taken, and the amendment to HB2441 was favorably passed.
Representative Whitmer stated that he has an amendment to HB2441 (Attachment 2). The amendment would require that any outsourced security and compliance audits would be required to be conducted by a company based in Kansas.
Representative Whitmer moved to amend HB2441 to require that the security and compliance audits are to be conducted by companies based in Kansas, seconded by Representative Smith. Following discussion, a vote was taken and the amendment was favorably passed.
Representative Highberger's no vote is recorded.
Representative Rooker moved to recommend HB2441, as amended, favorably for passage, seconded by Representative Arnberger. HB2441, as amended, was favorably passed.
Chairperson Barker opened the floor for requests for bill introductions. There were none.
