Chairperson Barker opened the hearing on HB2476. Chris Waggoner, Revisor, provided an overview of the bill (Attachment 7). HB2476 adds the term "alcoholic candy" to the Liquor Control Act definitions. Alcoholic candy is now included in the definition of alcoholic liquor to ensure that it is regulated like any other beer or alcohol under that definition. Questions were asked by Representative Ellis.
Chairperson Barker recognized Debbi Beavers, Director of the ABC, as a proponent of HB2476 (Attachment 8). The ABC has proposed this legislation due to frequent inquiries and questions regarding the application of the liquor control act to various alcohol-based food products such as alcohol filled or infused candies, ice cream, syrups,popsicles, and cupcakes. This legislation would provide clarification and bring any products with an alcohol content greater than 0.5 percent alcohol by volume under ABC regulation and would have to be sold by a liquor licensee. Questions were asked by Representatives Highberger, Carpenter, Ellis, and Arnberger.
There were no other conferees so Chairperson Barker closed the hearing on HB2476.
Chairperson Barker asked if there were any other requests for bill introductions. There were none.
