Chairman Waymaster opened the hearing and discussion on SB 109.
Dylan Dear, Legislative Research Department, provided an overview of the bill.
Chairman Waymaster made a motion to amend the contents of Sub HB 2364, including all adopted Omnibus positions by the House Appropriations Committee and technical amendments that staff deem necessary to implement adopted policies into Sub SB 109, which includes the current language concerning the claims against the state in SB 109. Representative Davis seconded the motion. Motion passed.
Chairman Waymaster made a motion for an amendment regarding the designation of Room 221-E as the meditation room in the Capitol Building, Representative Davis seconded the motion. Motion passed.
Chairman Waymaster introduced Jeff Chaney, Chief Deputy, Attorney General's Office.
Mr. Chaney presented an overview of the Governor's Budget Amendment # 2 (Attachment 4). He reviewed the fee fund lawsuit settlement agreement, which reflects an SGF transfer of approximately $3 million in FY 2018. There is an increased expenditure for compensation of plaintiffs legal fees in the amount of $76,650 for the Office of the State Bank Commissioner, and $28,350 for the Kansas Real Estate Commission for FY 2018.
Chairman Waymaster made a motion to add the Governor's Budget Amendment #2 (See attachment 4) to the bill. Representative Davis seconded the motion. Motion carried.
Representative Alcala provided background information on a claim that passed in the House last session but failed in the Senate Conference Committee.
Representative Alcala made a motion for an amendment to add $17,660 for Barbara Reece, claimant, which would be reimbursable at the discretion of the Director of the Division of Budget. The motion was seconded by Representative Ballard.
Discussion followed by committee members.
Representative Tarwater made a substitute motion to refer the status of this claim to the Joint Committee on Special Claims Against the State. Representative Davis seconded the motion. Motion failed.
Representative Alcala renewed the motion. Motion passed.
Representative Wolfe Moore provided an overview of the Healthy Families program. The expansion of the program would not impact the SGF as the approximate $3 million for FY 2018 and FY 2019 would be funded by Temporary Assistance to Needy Families (TANF) funds that have not been utilized.
Representative Wolfe-Moore made a motion to add $3 million from TANF funds for the Healthy Families Program for FY 2018 and FY 2019. Representative Carlin seconded the motion.

Representative Claeys reviewed a proviso regarding the bonding authority for the Department of Transportation (Attachment 5). He stated that the additional language would not be less than $350 million or exceed $400 million for FY 2018 and FY 2019.
Representative Claeys made a motion to add the language that would authorize the Department of Transportation to issue additional bonds in an amount not to exceed $400 million funding FY 2018 and FY 2019. Representative Helgerson seconded the motion.
Discussion followed by committee members regarding the motion. The minimum required spend for preservation is $350 million, of which $45 million for FY 2018 and $255 million in FY 2019, Representative Claeys noted. Concern was expressed regarding the minimum required spend.
