Chairman Waymaster opened discussion on the bill.
Scott Abbott, Office of the Revisor of Statutes, briefed committee members on the bill. The Bill establishes an on-site state employee health clinic; making and concerning appropriations for fiscal year ending June 30, 2018, for the Department of Administration.
Representative Davis made a motion for favorable passage of the bill. Representative Tarwater seconded the motion.
Discussion followed by committee members regarding the contents of the bill as related to the return on investment for future funding of the clinic. Representative Davis reviewed an amendment that included language to the bill regarding the following; location of clinics that are state owned or leased, determining the lowest responsible bidder, replacing physicians language to healthcare providers, and replacing chiropractic language to physical medicine (Attachment 1).
Representative Davis made a motion to approve the amendment.
Discussion followed by committee members regarding the original motion.
Representative Davis withdrew the motion for favorable passage of the bill, with the approval of the second.
Discussion continued by committee members regarding the bill. Concerns were expressed regarding leased property costs and time frame, definition of on-site healthcare providers and access to medical records. Scott Abbott responded to questions from committee members regarding the definition for healthcare providers, which are standard definitions throughout the statutes. Representative Davis stated that the recommended language change to healthcare provider from physician does not change the scope of practice or compliance issues related to State regulations and statutes.
Representative Landwehr made a substitute motion to include the language physician and healthcare provider in the amendment. Representative Ballard seconded the motion.
Discussion followed by committee members regarding the substitute motion. Scott Abbott stated that there is no requirement in the bill that stipulates what licensed individual needs to be at the clinic at any given time. He reviewed KSA 40-3401.
Representative Landwehr approved the recommended change of the motion to read physician or healthcare provider, which was approved by the second to the motion.
Scott Abbott stated that KSA 40-3401 contains lengthy definitions of healthcare providers.
Representative Landwehr renewed the motion. Motion failed.
Representative Schroeder made a motion to divide the amendments noted on page one and page two of the bill. Representative Carlin seconded the motion. Motion failed.
Discussion followed by committee members regarding the lowest responsible bidder and cost avoidance, which would be procured by the Department of Administration.
Representative Davis made a motion for favorable passage of HB 2418 as amended. Representative Tarwater seconded the motion. Motion passed.
Discussion continued by committee members regarding funding for the clinics. J.G. Scott, Legislative Research Department, stated that the money allocated for the clinics is a line item appropriation. Chairman Waymaster stated that funding for the clinics will be included in the General Government Budget Committee for annual review and discussions in the Appropriations Committee. Any savings captured in the fund would be used to fund the on-site clinics, he added.
Representative Helgerson made a motion to strike Section 2, lines 17 - 21. Representative Alcala seconded the motion.
Discussion followed by committee members regarding the motion. It was noted that savings in insurance premiums could be realized through wellness programs.
Representative Helgerson renewed the motion. Motion failed.
Representative Helgerson requested his vote in support of the motion be recorded in the minutes.
