Chairperson Barker opened the hearing on HB2389. Jason Long, Revisor, provided an overview of the bill (Attachment 1). Questions were asked by Representatives Houser, Highland, Williams, and Humphries.
Chairperson Barker recognized Representative Whitmer as a proponent of HB2389 (Attachment 2). He stated that he does have a number of concerns about the bill in its present form. He is assisting in the preparation of some amendments which, if adopted, would incorporate the standards from neighboring states, as well as commonly accepted industry and national association standards and Kansas regulatory standards. Chairperson Barker requested Representative Whitmer to share his proposed amendments with the Committee members. Questions were asked by Representatives Ruiz, Smith, Wilson, Karleskint, and Rooker.
Travis Lowe was recognized by Chairperson Barker as a proponent of HB2389 on behalf of the Kansas Society of Professional Engineers (Attachment 3). Questions were asked by Chairperson Barker and Representative Miller. Scott Heidner of Gaches, Braden & Associates, responded to Mr. Miller's question about the fees and length of time it would take to inspect rides at temporary carnivals.
Chairperson Barker recognized Mary Sabatini as a proponent of HB2389 (Attachment 4).
Chairperson Barker noted that there was written proponent testimony from Chris Flattery of Ottaway (Attachment 5).
Chairperson Barker recognized Zach Wilson of Fun Services as an opponent to HB2389 (Attachment 6). Questions were asked by Chairperson Barker and Representatives Rooker, Wilson, Miller and Weber.
Andrew Evans of Midland Empire Shows testified as an opponent (Attachment 7).
Chairperson Barker informed the Committee that they could ask questions of any of the opponents. Questions were asked by Representatives Whitmer, Humphries and Wilson to Mr. Evans. Representative Lusk asked who would be paying for the inspections. Jason Long responded that under the bill it would be the insurance company that issues the liability insurance policy. Representative Miller asked if self-inspections would be allowed, and Chairperson Barker responded that they would not be allowed.
Representative Highberger stated that he thinks the written testimony listed as proponent testimony of Chris Flattery of Ottaway should be listed as opponent testimony.
Chairperson Barker said that he is leaving the hearing on HB2389 open since neutral testimony will be provided to the Committee tomorrow.
