Mike Heim, Senior Assistant Revisor, provided a briefing on SB78.
Noting a change of seating for the meeting, Representative Blake Carpenter, Vice-Chair, asked for the will of the Committee on SB78.
Representative Keith Esau, Chair, moved the Committee pass SB78 favorably, seconded by Representative Brett Parker.
Discussion by the Committee followed.
Representative Francis Awerkamp moved the Committee pass a conceptual amendment, adding on line 29, at the end of the new section, a line stating, "Failure to receive such notice should not give rise to challenging the results of the election." The motion was seconded by Representative Esau.
Discussion by the Committee followed.
Representative Vic Miller, Ranking Minority Member, noted the tense of the verb might be more correct if it were "shall." Representative Awerkamp agreed he would say "shall."
There was further discussion on the amendment.
Mr. Heim answered questions from the Committee.
There being no further discussion, Representative Awerkamp closed on his motion.
Representative Awerkamp's amendment passed without objection.
Representative Esau moved the Committee pass SB78 favorably as amended, seconded by Representative Randy Garber.
Representative Brett Parker moved the Committee pass a drafted amendment, seconded by Representative Miller. Copies of the amendment were distributed to the Committee by Mike Heim. (Attachment 1).
Discussion on the amendment followed.
Bryan Caskey, Director of Elections, Office of the Secretary of State of Kansas, answered questions from the Committee.
There being no further discussion, Representative Parker closed on his amendment.
Representative Parker's amendment passed without objection.
