A motion was made by Representative Esau and seconded by Representative Gallagher to consider HB2359 as favorable for passage. The motion passed.
The Chair moved and Representative Koesten seconded to amend the bill to adjust titles and terminology (Attachment 8). Ms. Moyer explained that these technical amendments align terminology with current statutes. Responding to a question, Ms. Moyer replied that reimbursement to the Judicial Branch would be authorized only if the Judicial Branch solicits services from KITE (Kansas Information Technology Enterprise). The motion passed.
A motion was made by the Chair and seconded by Representative Lewis to amend the bill to restructure the IT Advisory Board (Attachment 9). Ms. Moyer explained that ITAB was created by the IT Executive Council in 1999 with some revisions added in 2006. This amendment enables agencies a wider voice regarding IT policy, and it places certain IT policies into statute. Members expressed serious concerns regarding the reach of the amendment and the authority given to the CITO (Chief Information Technology Officer). With the agreement of the second, the Chair withdrew the amendment.
The Chair moved and Representative Baker seconded to amend the bill by establishing rules and regulations (Attachment 10). Ms. Moyer stated that the amendment directs the Executive CITO to develop rules and regulations to prioritize agency IT functions. The motion passed.
The Chair suggested discussion of an amendment adding reporting requirements to the bill (Attachment 11). Members discussed the proposed changes at length. Ms. Moyer explained that the amendment would extend planned project budgets from three years to five years and add certain performance measures. Members commented on the amendment:
- A phased-in approach to the changes would provide a more orderly approach.
- Sweeping non-tax funds from fee-funded agencies into the State General Fund is problematic.
- An advisory group might better establish priorities.
The Chair announced that the amendment would be considered following the recess.
The Chair announced that the Committee would recess and reassemble following adjournment of the House.
The Chair recalled the meeting to order at 11:50 a.m.
A motion was made by Representative Terrell and seconded by Representative Esau to continue discussion of HB2359. The motion passed.
A motion was made by the Chair and seconded by Representative Gallagher to continue discussing the ITAB amendment (Attachment 9). A member recommended a minimum of four members from cabinet-level agencies. Ms. Moyer commented that current statutes provide at least four cabinet-level representatives and a minimum of four members representing other executive agencies. Representative Pittman offered a substitute motion, seconded by Representative Curtis, to specify the number of cabinet-level and other executive-branch agencies to be represented. The substitute motion passed.
The Chair moved and Representative Lewis seconded to require the CITO to submit reports that include projected budgets, fund balances, and performance measures (Attachment 11) A substitute motion was made by Representative Koesten, seconded by Representative Esau, to include two additional performance measures: cost savings and satisfaction ratings (Attachment 12). The motion passed.
Representative Pittman moved, seconded by Representative Curtis, to provide a two-year phase-in for the bill (Attachment 13). Representative Pittman commented that the bill seems to be so far-reaching that a time-lag for full implementation would be helpful, especially for the fee-fund agencies. The motion passed, 10-2.
A motion was made by Representative Curtis and seconded by Representative Baker to maintain existing contracts. A substitute motion was made by Representative Curtis and seconded by Representative Pittman to add to the language ", entered into before July 1, 2017." The substitute motion passed (Attachment 14).
