Chairperson Williams turned the committee's attention to the bill.
Mike Heim presented an overview of the proposed Cox amendment. The committee was in agreement with suggested changes to the proposed amendment. (Attachment 1)
The sub-committee, chaired by Representative Tom Cox, discussed concerns and details with the House Local Government committee. Annual licensing for common consumption areas would be reviewed by the Alcohol Beverage Control. The common goal is to allow business expansion and growth. Liability issues for common consumption areas are a concern, with permits being issued only to a Kansas resident or Kansas business owner from the Alcohol Beverage Control director. A municipality, local government, defines the applicable zone. City or county are candidates considered to hold and approve permits. Concerns were expressed as to whether a municipality would be willing to accept liability for common consumption areas.
Representative Cox moved, Representative Bishop seconded, to amend the bill by adopting Sub HB2277. Motion carried. Representative Cox moved, Representative Thimesch seconded, to recommend Sub HB2277 favorably for passage. Motion carried.
Chairperson Williams thanked the volunteers of the sub-committee: Chairperson Cox, Representative Bishop, Mike Heim and Debbie Beavers, Director, Alcohol Beverage Control.
There being no further business, the meeting was adjourned at 2:30 PM.
