Short Title
Enacting the Kansas cybersecurity act.

The Chair opened consideration of HB2359 and HB2331. He referenced two written testimonies:
- Alan Conroy, Executive Director, Kansas Public Employees Retirement System, recommending amendments to both bills (Attachment 1), and
- Jennie Chinn, Executive Director, Kansas Historical Society, recommending amendments for HB2359 (Attachment 2).
A motion was made by Representative Lewis and seconded by Representative Baker to recommend HB2331 as favorable for passage. The motion passed.
Representative Lewis moved and Representative Esau seconded to amend the bill. (Attachment 3). Revisor Jenna Moyer explained that the amendment deletes section 2(h) on page two, changes shall to may on page 6, line 27, and makes other technical corrections. The motion to amend passed.
The Chair moved, seconded by Representative Pittman, to amend the bill by striking the fiscal portion of the bill (Attachment 4). The motion passed.
Representative Terrell moved and Representative Esau seconded to amend the bill (Attachment 5). The motion passed.
The Chair moved and Representative Koesten seconded to further amend the bill (Attachment 6). Ms. Moyer explained that the amendment adds a reporting structure to the bill. A member expressed concern about creating a policy without a budget. The Chair replied that the House Appropriations and the Senate Ways and Means committees will provide the funding. Another member recommended separating the policy from funding sources. He also noted that security breaches addressed in the bill need an action plan for emergencies. The Chair commented that the grant fund may be used for emergency breaches. The motion passed.
A motion was made by the Chair and seconded by Representative Ohaebosim to establish rules and regulations for the bill (Attachment 7). Ms. Moyer noted that the rules and regulations will provide a framework to comply with national standards. A member expressed concern that if the rules and regulations are too detailed, the information could be exploited by hackers. A member expressed concern that the bill will create an inordinate burden on agencies to limit their ability to carry out their assigned functions.
The Chair announced that discussion on the bill would continue following adjournment of the House.
