Chairperson Longbine opened the hearing on SB205. Elaine Ma presented a brief overview of the bill.
Alan Conroy presented detailed informational testimony regarding the provisions of the bill and how expanding the definition of participating service would apply for both KPERS and KP&F members. He stated that the new definition would apply retroactively to July 1, 2014. Additional topics discussed included:
- Current processes
- Sick and annual leave
- Light duty assignment
- Temporary duty
- Workers' compensation
- Paid administrative leave
- Other personnel situations
- Effective date
- HB 2289
Mr. Conroy responded to questions from Senators Suellentrop and Givens. (Attachment 4)
Ed Klumpp testified in favor of SB205. He told the committee that clarifying KPERS and KP&F members' remaining in active status in the retirement system while on paid leave approved by the employer was a critical problem and was chosen as a priority legislative issue for this session. Mr. Klumpp also said since the hearing in the House Committee on HB2289, KPERS had worked with KP&F representatives to find common language that addresses the concerns on both sides of this issue. Mr. Klumpp pointed to a suggested amendment attached to his written testimony and urged the committee to amend SB205 to include the agreed-upon language, and to favorably recommend passage. (Attachment 5) Mr. Klumpp answered a question from Senator Rogers.
Chairperson Longbine directed the committee's attention to the proponent written-only testimony of:
- Sean P. McCauley, Attorney for Kansas State Lodge of the Fraternal Order of Police (FOP); General Counsel for Kansas State Troopers Association, and also Missouri State FOP (Attachment 6)
- Dennis Phillips, on behalf of the Kansas State Council of Fire Fighters (Attachment 7)
- Brock Ingmire, Manager of Policy and Research for The League of Kansas Municipalities (Attachment 8)
There being no further questions or discussion, and no other conferees or written-only testimony submitted, Chairperson Longbine closed the hearing on SB205.
