Natalie Scott gave a brief overview of HB2264. Chairperson Jennings summarized the history of 2016 SB367 and leading up to the final action on HB2264.
Representative Finch moved to amend HB2264 with the numbered amendments 1, 2, 8, 11 and 17 (Attachment 1), seconded by Representative Whitmer.

Representative Becker moved a substitute motion to amend numbered amendment 9, to strike the sentence in the right lower box in the margin that reads "Participation in an immediate intervention program is not required to be offered to a juvenile who was originally charged with a felony and, as a result of a plea agreement reached between the juvenile and prosecuting attorney, the charge has been amended to a misdemeanor.", seconded by Representative Ward.
The motion failed to amend HB2264 with the Becker substitute amendment.

Representative Koesten moved to amend HB2264 with the numbered amendment 21 and making the change within the lower box section (d), line (12) striking the word "inadequate" and inserting the word "an availability of" (Attachment 4), seconded by Representative Finch.

Representative Finch requested that the minutes reflect the clear intention of the committee as to this amendment. This amendment in no way modifies the findings required to be made by the court with respect to the initial order of out of home placement pursuant to Section 33 of 2016 SB367 and only serves to supplement those required findings in order to protect the interest of the state in assuring the highest level of federal IV-E funding is available. Finch stated this amendment is not intended to create a set of alternative findings upon which an out of home placement may or may not be made.
