Chairperson Kelly called for final action on HB2268.
KPERS Executive Director Alan Conroy provided informational testimony (Attachment 1). Mr. Conroy responded to questions from the Committee.
Representative Trimmer moved, Representative Vickrey seconded, to recommend HB2268 favorably for passage.
A proposed balloon amendment to HB2268 was distributed and reviewed by David Wiese (Attachment 2). The amendment would return the sunset date to July 1, 2020.
Representative Thompson moved, Representative Powell seconded, to adopt the proposed balloon amendment to HB2268. Motion carried.
A proposed balloon amendment to HB2268 was distributed and reviewed by David Wiese (Attachment 3). The amendment would add an exemption for Kansas Board of Regents retirees.
Representative Eplee moved, Representative Hawkins seconded, to adopt the proposed balloon amendment to HB2268. Motion carried.
A proposed technical balloon amendment to HB2268 was distributed and reviewed by David Wiese (Attachment 4). The amendment would allow KBOR to adjust the assumed rate of return without the Committee's approval.
Representative Trimmer moved, Representative Finney seconded, to adopt the proposed technical balloon amendment to HB2268. Motion carried.
A proposed balloon amendment to HB2268 was distributed and reviewed by David Wiese (Attachment 5). The amendment would clarify the exemption for independent contractors and employees of third-party entities.
Representative Hawkins moved, Representative Vickrey seconded, to adopt the proposed balloon amendment to HB2268, contingent upon replacing the words "full time" with "exclusively" in Section (7)(e)(ii). Motion carried.
A proposed balloon amendment to HB2268 was distributed and reviewed by David Wiese (Attachment 6). The amendment would consolidate the exemption categories of "special ed," "hard-to-fill" and "hardship" into one category.

Representative Trimmer moved, Representative Blex seconded, to adopt the proposed balloon amendment to HB2268. Motion carried.
A proposed balloon amendment to HB2268 was distributed and reviewed by David Wiese (Attachment 8). The amendment would exclude mileage and per diem payments from the $25,000 earnings cap calculation for retired KPERS members serving in the legislature if these payments are not treated as taxable income for the legislator.
Representative Jennings moved, Representative Finney seconded, to adopt the proposed balloon amendment to HB2268. Motion carried.
Representative Hawkins moved, Representative Jennings seconded, to recommend HB2268, as amended, favorably for passage. Motion carried.
