Minutes for HB2162 - Committee on Taxation

Short Title

Sales taxation; time for payment by retailers.

Scott Wells, Assistant Revisor provided an overview on HB2162.  Mr. Wells said HB2162 concerns sales tax and returns that are filed by retailers.  Currently a retailer who has a total tax liability for the calendar year that exceeds $32,000. must repay their monthly return.  The bill would increase the threshold from $32,000. to $40,000. 

Mr. Wells stood for questions from the Committee.

Kathleen Smith, Director, Department of Revenue provided an  overview on the fiscal note for HB2162 stating there will be a deacceleration in the first period of $1.4 million. 

Proponents

Corey D. Peterson, President and Owner of Hemslojd, Inc in Lindsborg, Kansas testified as a proponent of HB2162(Attachment 1)   Mr. Peterson noted HB2162 would increase the threshold for retailers required to pay expedited sales taxes on a monthly basis to the Department of Revenue.

Mr. Peterson stood for questions from the Committee.

Eric Stafford, Vice President of Government Affairs, The Kansas Chamber, testified as a proponent of HB2162. (Attachment 2)

Daniel Murray, Kansas State Director, National Federation of Independent Business testified as a proponent of HB2162(Attachment 3)  Kansas does not make an allowance for retailers to retain a portion of the sale tax they collect to remit to the Department of Revenue by contrast Missouri, Oklahoma, Nebraska and Colorado who provide for some form of allowance.  

Discussion followed on data of numbers effected or second priorities for the small business group
