Minutes for SB149 - Committee on Judiciary
Short Title
Enacting rules for briefs in a criminal matter or postconviction case in the supreme court or court of appeals; relating to the attorney general.
Minutes Content for Mon, Feb 13, 2017
Jason Thompson gave a brief on the bill saying that the bill proposes a new statute concerning criminal matter or post conviction case in the Supreme Court or Court of Appeals.
Proponent:
Attorney General Schmidt testified in support (Attachment 1) of SB 149 saying that it clarifies the longstanding authority of the attorney general as the State's chief legal representative in all appellate matters and in federal court. He explained that the reason they brought this bill was because the Supreme Court decided to repeal a rule, Rule 6.10, and should this go away there would be no obligation to submit briefs for review by the Attorney General's Office in appellate matters or in federal court.
After a brief question and answer period, Chairman Wilborn closed the hearing.
