Relating to certain department of agriculture fees.

Chair Hoffman opened the hearing on HB2134 at 3:32pm.
Kyle Hamilton, Assistant Revisor, Office of The Revisor of Statutes, provided an overview of HB2134 and the statutes that it affects. (Attachment 1) There is a Fiscal Note for HB2134.
Chad Bontrager, Deputy Secretary, Kansas Department of Agriculture, appeared before the Committee in support of HB2134. This bill extends the sunset on fees related to Pesticide and Fertilizer and Water Resources. HB2134 also reinstates the fees for size 1 and 2 Dam Safety Inspections, thus allowing the department to complete the inspections of the 18 delinquent dam inspections, as well as any future delinquent inspections. (Attachment 2)
Randy E. Stookey, General Counsel, Kansas Grain and Feed Assn and Kansas Agribusiness Retailers Assn, appeared before the committee as a neutral with concerns on HB2134. While we are in support of extending the sunset on the fees, we have concerns about the ability of the Secretary of Agriculture to re-align administrative fees away from the state water plan fund and the Kansas Agriculture Chemical Remediation Reimbursement Fund. (Attachment 3)
There were no opponents of HB2134.
Mr. Bontrager and Mr. Stookey answered questions from the committee.
