Jenna Moyer gave a bill brief on SB 62 saying that it amends the law to provide the right to appeal certain decisions that deny a petition to summon a grand jury.
Phillip Cosby began his testimony (Attachment 12) of SB 62 by explaining three different types of grand juries. He went on to describe that this amendment is needed because a recent ruling by a Johnson County District judge dismissed a citizen's petition as defective. In addition, he explained, a motion arguing that a grand jury petition rulings have no statutory right to appeal. These two examples prove that we need to have this bill.
Chairman Wilborn directed the Committee's attention to the other written, proponent, testimony by Kathy Ostrowski (Attachment 13), and opened the hearing up for questions.
During the question and answer period, the topic concerning appeal and the process in which that happens was addressed. In addition some concerns about Mr. Cosby's proposed Constitutional amendment was addressed.
Chairman Wilborn, seeing no further questions, closed the hearing on SB 62.
Chairman Wilborn then asked the Committee for a motion to approve minutes for January 10, 11, 12, 17, 18, and 19. Senator Fitzgerald moved to accept the minutes, and Senator Haley seconded. Motion carried.
Chairman Wilborn then adjourned the meeting at 11:49am.
