Chairperson Williams turned the committee's attention to HB2094- Municipalities; contracts with other municipalities.
Chairperson Williams opened the hearing on the bill.
Mike Heim presented an overview on the bill.
Cindy Green presented testimony in support of the bill, stating it would add entities to the definition of "municipality," in the direction of public safety and public works. Numerous cities have agreements between them to share or contract for services. (Attachment 1)
Rob Gilligan presented testimony in support of the bill, commenting there is an interlocal agreement statute for school districts in K.S.A. 72-8230 which requires the approval of the State Board of Education and review by the Attorney General's office. The bill expands who else can use interlocal agreements and does not appear to require separate legal entities as addressed in K.S.A. 12-2904a. (Attachment 2)
Larry McAulay presented testimony in support of the bill, stating if the bill is passed, Johnson County would be able to use this statute to contract with other levels of government to provide information technology services, public road improvements, housing assistance programs, and storm water management projects. Expansion could include school districts, library districts, road districts, water districts, drainage districts, sewer districts, parks, recreation cemetery and fire districts. (Attachment 3)
Melissa Wangemann presented written only testimony in support of the bill commenting it would allow a county to enter into more cooperative agreements with other local governments, creating a more efficient process. (Attachment 4)
Mike Heim stated for clarification the difference between interlocal and contract as separate divisions in the law. Home Rule provides power for sharing services. Currently, the Attorney General office reviews contracts for services. Bill changes would be for efficiency purposes. It was noted this bill was previously passed by the House in 2016 with no opposition.
Chairperson Williams closed the hearing on the bill.
Representative Alcala moved, Representative Cox seconded, to recommend HB2094 favorably for passage. Motion carried.
