Staff briefed the Committee on HB2040 and answered questions.
The Chairman recognized Representative Highland as the first proponent of this bill. (Attachment 1) According to Representative Highland the issue of vehicles passing stopped school buses while loading or unloading children had been brought to his attention by the Transportation Director of USD 378 Riley County Schools. Representative Highland said he had personally seen this happen. He said this bill also contains remedies to include increasing the fines for violating existing law. After his testimony, he stood for questions.
Frank Clark, Transportation Director of USD 378 Riley County Schools, was the next proponent to speak.(Attachment 2) Mr. Clark provided information he had researched and gathered concerning better enforcement of the Kansas bus stop sign law. He stood for questions.
The Chairman drew the Committee's attention to written testimony submitted in support of HB2040 by the Kansas Highway Patrol.(Attachment 3)
Larry Baer, General Counsel for the Kansas League of Municipalities testified as an opponent to this bill Mr. Baer said The League opposes specific provisions in the bill because they create unfunded mandates upon cities.(Attachment 4) He also said there is a strong possibility that the law will be challenged on a constitutional basis. He stood for questions.
There were no other proponents, neutrals or opponents so the Chairman closed the hearing on HB2040 and opened the hearing on HB2060.
