Updating the code of civil procedure.

Jason Thompson briefed the Committee on SB 13, saying that the bill updates the Kansas Code of Civil Procedure to incorporate recent amendments made to the Federal Rules of Civil Procedure into our Kansas Code. In addition, he gave a brief explanation about what the bill amends and repeals.
Seeing no questions, Chairman Wilborn moved to the next order of business.
Proponent:
Washburn Law School Professor, James Concannon, began his presentation (Attachment 1) saying that SB 13 amends the Kansas Code of Civil Procedure to incorporate the 2015 amendments to the Federal Rules of Civil Procedure and then also a single minor 2016 amendment to Federal Rule 6. He continued his presentation by giving background on the federal and state rule making processes. Professor Concannon continued speaking about SB 13 saying that it focuses on the 2015 amendments discovery rules, the pretrial conference or case management conference rule, as well as minor amendments to three other rules. Professor Concanon then explained the reasoning behind his support for the bill and each component.
After a brief question and answer period, and seeing no other conferees, Chairman Wilborn closed the hearing on SB 13.
Chairman Wilborn took a moment to recognize Senator Goddard's intern Seth Dinkel.
Staff handed out the Session Law version of SB 367 and Conference Committee Report Brief for the bill, and the report of the Juvenile Justice Workgroup for the following day's review of the bill.
Chairman Wilborn adjourned the meeting at 11:11am.
