The Chair opened the hearing on HCR5013, urging Congress to give state insurance regulators authority over Medicare Advantage Plans.
Proponent testimony was given by Eric Turek, Director Government Affairs, Kansas Insurance Department (KID). The conferee stated eleven (11) percent of all health insurance-related complaints from Kansas policy holders submitted to the KID concern Medicare Advantage deceptive marketing practices. Currently the KID is unable to assist aggrieved policy holders because Medicare Advantage plans are regulated by congressional Centers for Medicare and Medicaid, since the passage of the Medicare Modernization Act in 2003. (Attachment 1) The conferee stood for questions, and when asked, explained the difference between medicare supplemental plans and medicare advantage plans.

The Chair closed the hearing on HCR5013.
The Chair, without objection from committee members, suspended the rules and proceeded to committee action with respect to HCR5013.
Motion to adopt HCR5013 was made by Representative Neighbor and seconded by Representative Meyer, motion carried.
The meeting was adjourned by the Chair.
