Minutes for SB237 - Committee on Judiciary

Short Title

Requiring the court to consider the value of retirement accounts if a person loses income for certain reasons and eliminating the exemption of pension and retirement moneys from claims to fulfill child support obligations.

Chair Humphries opened the hearing on SB237 at 5:15pm.

Jason Thompson, Office of Revisor of Statutes, presented the bill brief.   (Attachment 18)

Proponent Josh Ney, Kriegshauser Ney Law Group, testified that there is a need for more simple guidelines for child support obligations.  He supports SB237 because it would provide greater balance to the child support formula and ensure more parental resources are used to support minor children.    (Attachment 19)

Proponent Senator Kellie Warren, Senate Judiciary Committee Chair/Senate District 11, testified that the Senate Judiciary Committee made two amendments with the help of the Kansas Public Employees Retirement System (KPERS) and  Kansas Department for Children and Families (DCF) to help get child support arrearages from a parent who has accessible retirement funds. No written testimony was submitted.

Chair Humphries drew attention to the Proponent Written Only testimonies.

Chair Humphries closed the hearing on SB237.

 

Chair Humphries drew attention to the meeting minutes presented for approval.

Chair Humphries moved, Representative Williams seconded to approve minutes from January 15, January 21, January 27, January 28, January 29, and March 4 as corrected by Jason Thompson, Senior Assistant Revisor.

Representative Carmichael explained he had not had time to review the minutes and would abstain from voting.

The motion carried.
