Short Title
Providing that prior convictions of a crime that is determined unconstitutional by an appellate court shall not be used for criminal history scoring purposes unless the basis of the determination of unconstitutionality by the appellate court is later overruled or reversed.

Proponent Marc Bennett, Kansas County & District Attorneys Association/Sedgwick County District Attorney's Office testified in support of the changes HB2401 would make to K.S.A. 21-6810 (9). (Attachment 22)
Opponent Emily Brandt, Kansas State Board of Indigents' Defense Services (BIDS) Legislative Committee, testified that all HB2401 does is undo the clarity that the State vs Robert Smith opinion provided for courts to fairly and evenly apply in criminal convictions. (Attachment 23)
