Chair Humphries opened the hearing on HB2389 at 4:08pm.
Jason Thompson, Office of Revisor of Statutes, presented the bill brief. (Attachment 10)
Proponent Representative Laura Williams testified that this bill addresses the issue of allowing a judge to take into consideration previous convicted offenses of sex crimes when setting bail. Representative Williams shared a private citizen's testimony on why this piece of legislation is important to her and advocate on her behalf for a change in policy in the state of Kansas. (Attachment 11)
Proponent Stephen M. Howe, Johnson County District Attorney, 10th Judicial District, testified that this bill requires the Court to consider the prior offenses when considering bond. The language of the bill would modify it from discretionary to mandatory as part of the Courts decision making process on bond. (Attachment 12)
