Vice Chair Titus opened the hearing on HB2359

Natalie Scott, Revisor's office, provided an overview of the bill and stood for questions.  (Attachment 34)

Hon. Marilyn Wilder and Rachael Pirner, Kansas Judicial Council, provided testimony in support of the bill.  They stated this bill will update existing Kansas statutes to align with the Uniform law, and help Kansas better work with other states regarding jurisdictional issues. (Attachment 35)

Rocky Nichols, Executive Director, Disability Rights Center of Kansas, provided testimony supporting this bill.  He supports because of  lifesaving, pro-disability and person-centered aspects.  The testimony he submitted provides examples of the much needed and effective policies contained in the bill.   (Attachment 36)

Jeanne Gawdun, Director of Government Relations, Kansans for Life, provided testimony saying they support the bill with the House amendment, and asks the committee to pass the bill out favorably.  (Attachment 37)

Michelle Richart, U.S. Department of Defense, provides testimony in support of the bill.  Currently Kansas remains one of only a handful of states not party to this Act,  She stated this lack of uniformity paces undue burdens on military families with adult dependents, forcing them to navigate a complex and costly legal process each time they relocate.  (Attachment 38)

  • Glenda DuBoise, State Director for AARP Kansas (Attachment 41)

  • Haley Ordoyne, State Long Term Care Ombudsman, Office of the State LTC Ombudsman (Attachment 42)

  • Chrisy Khatib, Kansas Department for Children and Families (Attachment 43)

Proponent conferees stood for questions.

Joan Kelly, National Council on Severe Autism, spoke in opposition of the bill.  They request the committee amend the bill and insert protective language, provided in her written tetimony, to support legal representatives who provide oversight and assistance in the lifelong care for individuals with the most significant cognitive deficits,  (Attachment 44)
